1. Accepting these terms
These Terms of Service ("Terms") are an agreement between you and Pixelands ("Pixelands", "we", "us"), covering the Pixelands game, its servers, and this website (together, the "Service").
By creating an account, playing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy and Community Rules are part of these Terms.
2. Who can play
- You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher.
- If you are under 18, you must have permission from a parent or guardian, and they must agree to these Terms on your behalf.
- You must not be barred from using the Service under any applicable law, and you must not be using it from a country subject to relevant sanctions or embargoes.
- If your account has previously been terminated for breaking these Terms, you may not create a new one.
Pixelands is rated 12+ and is not designed for, or directed at, young children.
3. Your licence to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Pixelands client on devices you own or control, and to access the Service for your own non-commercial entertainment.
You may not:
- Copy, sell, rent, sublicense or redistribute the client.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or network protocol, except where that restriction is prohibited by law.
- Modify the client, or use modified clients, bots, macros, automation, packet editors, memory editors, or anything else that gives you capabilities the ordinary game does not.
- Access the Service through anything other than our official client.
- Interfere with, overload, or attempt to gain unauthorised access to our servers or another player's account.
- Scrape, harvest or mass-collect data from the Service.
4. Your account
- You are responsible for everything that happens on your account, including anything done by someone you gave access to.
- Keep your password secret. Do not share your account, sell it, buy one, or transfer it. Account sharing is the single most common cause of "I was hacked" reports.
- Use a password you do not use on other websites.
- Tell us promptly at pixelandsgame@gmail.com if you think your account has been compromised.
- Your username must not impersonate anyone, imply staff status, or breach the Community Rules. We may reclaim or rename accounts that do.
- Guest accounts are tied to the device that created them. If you do not register a guest account, it may be lost permanently when you reinstall or change device, and it may be removed after long inactivity.
5. Rules of conduct
The full list, with examples and consequences, is in the Community Rules. In summary, do not:
- Harass, threaten, bully, or sexually harass anyone; use slurs or hate speech.
- Post or build sexual content, graphic violence, or anything involving minors inappropriately.
- Scam, phish, impersonate staff or other players, or run fake giveaways.
- Cheat, exploit bugs, dupe items, or use unauthorised software.
- Trade in-game items or accounts for real money outside the official purchase system.
- Advertise other games, services, or attempt to recruit players to off-platform scams.
- Share anyone's personal information, including your own.
- Attempt to evade a mute or ban.
If you find a bug that gives you an unfair advantage, report it rather than using it. We treat deliberate exploitation very differently from finding something and telling us.
6. Virtual items and currency
The important part in one sentence: Gems, PixBits, items, worlds, world locks and everything else in the game are licensed to you for use inside Pixelands, have no real-world value, are not your property, and cannot be redeemed for money.
- You receive a limited licence to use virtual items within the Service. You do not own them, and no title or property interest transfers to you.
- Virtual items have no monetary value, are not real currency, are not redeemable for cash or anything of value outside the game, and are not transferable outside the Service.
- We may add, change, rebalance, re-price, or remove items, currencies and features at any time. A game that never rebalances anything is a broken one.
- Your licence to virtual items ends when your account ends, for any reason, with no refund or compensation.
- Trades between players are final. We are not obliged to reverse a trade you regret. We may reverse transactions that resulted from cheating, duping or fraud.
- Real-money trading is prohibited. Selling, buying or exchanging accounts, items or currency for real money outside our official purchase system is a bannable offence, and we cannot help you when — not if — you get scammed doing it.
7. Purchases and refunds
All sales are final. We do not offer refunds. Full detail, including the two situations where we will put things right, is on our Purchases and refunds page, which forms part of these Terms.
- Pixelands is free to play. Some content — Gems, packs and similar — is available for real money.
- Purchases are made through Ko-fi at ko-fi.com/pixelands, which is our only official sales channel. Payment is processed by Ko-fi and its payment processors under their own terms. We never receive your card or bank details.
- Purchases are credited to the account named on the order, manually. You must provide your exact in-game username when ordering; without it we cannot identify the account to credit.
- All sales are final. We do not refund change of mind, mistaken purchases, dissatisfaction with an item or a random pack's contents, items lost in gameplay or to another player, accounts suspended for breaking these Terms, deleted accounts, or content later changed or removed.
- We will put it right if we got it wrong. If you paid and did not receive your purchase, we will credit it, or refund it if we genuinely cannot. If you received the wrong thing, we will correct it.
- Prices may change, and may differ by region and over time because of currency and tax.
- You are responsible for all purchases made on your account and with your payment method, including by anyone else with access to them.
- Chargebacks or payment reversals will result in removal of the purchased content and suspension of the account.
- Buying or selling Gems, items, worlds or accounts anywhere other than the official channel above is prohibited under section 6 and is not protected by anything in these Terms.
Consumers in the UK and EU: you normally have a 14-day right to withdraw from a purchase of digital content. By buying, you expressly request immediate delivery of that content and acknowledge that you lose the right to withdraw once delivery has begun.
Nothing in this section removes rights you have under the consumer law of your country that cannot be excluded by contract — including the right to a remedy where digital content was not supplied, or was not as described. "All sales are final" governs changing your mind; it does not limit our obligation to deliver what you paid for.
If Pixelands is later distributed through the Apple App Store, Google Play or Steam, purchases made in those versions will be processed by that platform's billing system and that platform's refund policy will apply to them instead of this section.
8. Things you build and write
Worlds, builds, signs, world names, chat and anything else you create in the Service is "Your Content". You keep whatever rights you have in it.
To be able to run the game at all, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, adapt and distribute Your Content for the purpose of operating, improving and promoting the Service. This licence ends when you delete Your Content or your account, except for copies retained in backups, in moderation records, or where the content has been shared into other players' worlds or accounts.
You confirm that Your Content is yours to share and does not infringe anyone's rights, and you accept that:
- Anything you say in public chat or build in a shared world is visible to other players and is not private.
- We may remove, edit or reset content that breaks these Terms or the Community Rules, without notice.
- We do not pre-screen everything, but chat is automatically filtered and reported content is reviewed by moderators.
If you believe content on the Service infringes your copyright, email pixelandsgame@gmail.com with a description of the work, where it appears, your contact details, and a statement that you believe the use is unauthorised.
9. Our intellectual property
The Pixelands name, logo, client software, artwork, sounds, items, characters, world designs and all other game content are owned by us or our licensors and are protected by copyright and trade mark law. Nothing in these Terms transfers any of it to you.
You may make and share videos, streams and screenshots of your own gameplay, including monetised ones, provided you do not imply we endorse or sponsor them, do not use our branding as your own, and do not use them to promote cheating or real-money trading. We can withdraw this permission if it is abused.
10. Changes to the game and to these Terms
- Pixelands is a live service. We may change, update, add, remove or discontinue features, content, or the whole Service, at any time.
- We may need to take servers down for maintenance, sometimes without notice.
- If we discontinue the Service permanently, we will give notice where we reasonably can. No compensation is owed for virtual items.
- We may change these Terms. The "last updated" date always reflects the current version. Material changes will be announced in-game and on Discord before taking effect, and continuing to play afterwards means you accept them.
11. Suspension and termination
We may warn, mute, suspend, ban, reset worlds, remove items, or terminate an account where we reasonably believe these Terms or the Community Rules have been broken, where required by law, or where necessary to protect other players or the Service.
Serious breaches — cheating, duping, real-money trading, harassment, threats, and anything involving minors — can result in an immediate permanent ban with no warning.
You may stop playing at any time and delete your account from My Account → Delete Account in game, or via our deletion page.
On termination, your licence ends and your virtual items are forfeited without refund. Sections 6, 8, 9, 12, 13, 14 and 16 survive termination.
You can appeal a punishment — see Appeals.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will never be lost. We are not responsible for:
- The conduct of other players, including scams, harassment, or anything they build or say.
- Loss of virtual items, progress or worlds resulting from bugs, outages, restores, hardware failure, or account compromise.
- Your internet connection, device, or platform.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits your non-excludable statutory consumer rights.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill, or virtual items, arising out of your use of the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD 50.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
14. Governing law and disputes
Placeholder — must be completed before publication.
These Terms are governed by the laws of [COUNTRY / STATE], and the courts of
[COUNTRY / STATE] have jurisdiction over any dispute, without regard to
conflict-of-law rules.
If you are a consumer resident in the UK, EU, or another jurisdiction whose law gives you the right to bring proceedings in your own country, or grants you the protection of mandatory local consumer law, that right is unaffected by the clause above.
Talk to us first. Most disputes are resolved faster by emailing pixelandsgame@gmail.com than by anything formal. Please contact us before starting proceedings.
15. Additional terms for Apple App Store users
If you obtained the Pixelands app from the Apple App Store, the following apply and prevail over anything inconsistent elsewhere in these Terms:
- These Terms are between you and Pixelands only, not with Apple. Pixelands, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services in relation to the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Pixelands, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Pixelands, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Any questions, complaints or claims about the app should be directed to pixelandsgame@gmail.com.
16. General
- Entire agreement. These Terms, the Privacy Policy and the Community Rules are the whole agreement between us about the Service.
- Severability. If any provision is found unenforceable, the rest stays in force.
- No waiver. If we do not enforce a provision, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of the Service, on notice.
- No third-party rights, except as expressly stated for Apple in section 15.
- Language. The English version of these Terms governs if a translation conflicts with it.
